The Framework for Play
These terms govern our shared space—the rules of engagement for creators, players, and the invisible systems that connect them. They are not abstract legalese; they are the design principles for a functioning studio ecosystem, written for the engineer building at midnight and the artist iterating on a sprite sheet. Read them with the same intention you approach a new toolchain.
The Scope of Our Agreement
When you access winetra.space, you enter a license to use our game engines, asset libraries, and development tools (collectively, the “Suite”). This agreement extends to all users, whether you are a client commissioning a bespoke engine, a freelancer integrating our plugins, or a student using our educational assets. The terms are non-negotiable but built with an understanding of real-world constraints—tight deadlines, budget limitations, and the need for creative flexibility.
Our systems communicate via API and file exchange. By using these channels, you accept the technical terms of service for data transmission, error handling, and version control. We do not store raw creative assets indefinitely; our logs retain system-level metadata for debugging and security audits. You retain ownership of your original work; we claim ownership of the tool’s proprietary algorithms and underlying code.
Decision Lens: User Roles & Permissions
- Independent Developer: Full Suite access under our Pro license. You may deploy assets in commercial products up to $50,000 annual revenue.
- Agency Team: Enterprise license required. Admin controls for user management, audit logs, and asset pooling.
- Educational License: Strictly for non-commercial projects. Watermarked assets, no commercial redistribution permitted.
Trade-Off Map: What You Gain vs. What You Trade
What You Gain
- Stable, documented APIs with backward compatibility guarantees for 2 major versions.
- Access to a vetted asset library with tested performance profiles (120fps on target hardware).
- Priority support for critical toolchain bugs affecting your project timeline.
- Seamless integration with common IDEs (VS Code, JetBrains Rider) via extension.
What You Trade
- Complete creative control; our tools are opinionated and follow a specific workflow.
- The right to re-sell our base assets as standalone products (modified works are permitted).
- Offline functionality; a persistent connection is required for license validation.
- Use of our data for anonymized performance analytics (opt-out available for Pro+ tier).

“Tools fail. Deadlines pass. Your warranty is not our promise of perfection, but our commitment to fixing what breaks when you’re under pressure.”
Liability & Indemnification
We limit our liability to the amount paid for your specific license in the 12 months preceding the claim. This is not a discount; it’s a trade-off. By accepting these terms, you agree not to hold us liable for lost revenue, corrupted assets, or delays in your project timeline. You are responsible for backing up your data and verifying outputs against your quality standards. Our tools are professional-grade, but they operate within a complex hardware/software matrix we do not fully control.
Termination & Survival
We may terminate access for violations of these terms, specifically related to asset redistribution or security breaches. Upon termination, you lose access to the Suite and cloud assets, but you retain the right to use assets in shipped projects (with proper attribution). A 30-day data export window is provided for Pro-tier users. The clauses on liability, intellectual property, and dispute resolution survive termination indefinitely.
Dispute Resolution
Any dispute arising from these terms will be resolved through binding arbitration in Rome, Italy. This is a deliberate design choice to avoid the cost and variability of court systems, especially for cross-border disputes. You waive the right to a class-action lawsuit. This is a significant trade-off; we recommend reading the full arbitration clause (Section 7.4) with your legal counsel.
Common Pitfall
“I’m just prototyping, I’ll worry about the license later.”
Many projects are green-lit because a prototype looked compelling. If that prototype uses proprietary assets you haven’t licensed for commercial use, you may be forced to rework it under crunch. Always map your license tier to your project’s roadmap stage.
